保加利亚基本上采用注册在先的商标保护原则，授予在先申请人商标权，但是使用人在保加利亚享有某些权利。如果相同商标注册申请同时在相同或类似商品上提交，授予最先开始并连续使用该商标的申请人。
保加利亚商标注册申请人资格：
任何个人、企业、法人团体均可申请商标注册。外国人和保加利亚国民一样可申请商标注册。在保加利亚没有居所或没有营业场所的申请人必须指定在保加利亚注册的工业产权代理。现在工业产权代理职业已放开，因此申请人可任意指定注册代理。
申请所需文件：
1、申请人的名称、地址、营业范围。
2、商标图样。
3、经申请人签署的委托书。
4、商品和服务清单。
5、外国申请人还需提供企业法人营业执照或相关证明。
审查流程：商标申请要经过形式审查和实质审查。不完备的申请必须在官方提出要求之日起3个月内予以完备，否则将被视为放弃申请。

注册有效期：10年，自申请之日起计算。
